JCM Planning provides project planning, programme management, and NEC support services in the United Kingdom. By accessing or using this website and/or instructing us to provide services, you confirm that you have read, understood, and agree to be bound by these Terms of Service (the “Terms”).
All services will be agreed in writing (including by email) by way of a proposal, quotation, or similar document (the “Engagement”). The Engagement will set out the scope, fees, deliverables, and any applicable assumptions. We will perform the services with reasonable skill and care.
You must provide accurate, complete, and timely information, access to relevant project data, and decisions and feedback as reasonably required. We shall not be liable for any delay, defect, or failure resulting from inaccurate, incomplete, or late information or instructions.
Fees are as stated in the Engagement. Unless otherwise agreed in writing, invoices are payable within 14 days of the invoice date. We reserve the right to suspend or withhold performance where any undisputed invoice is overdue. Overdue sums may accrue interest and reasonable recovery costs in accordance with applicable UK law.
All intellectual property rights in our website content, materials, and deliverables remain the property of JCM Planning (or our licensors). Subject to full payment and the Engagement, you are granted a limited, non-transferable, non-exclusive licence to use deliverables solely for your internal purposes for the relevant project; no other use, copying, adaptation, distribution, or publication is permitted without our prior written consent.
To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with the services (whether in contract, tort (including negligence), breach of statutory duty, or otherwise) shall be limited to the total fees paid for the relevant services giving rise to the claim. We shall not be liable for any indirect, incidental, special, or consequential loss, including loss of profit, loss of revenue, loss of business, delays, or project overruns.
We will treat your confidential information as confidential and will not disclose it to any third party except where required by law, by a competent regulatory authority, or as necessary to perform the services (including to our professional advisers and subcontractors subject to appropriate confidentiality obligations).
